			<content:encoded><![CDATA[<p>A Suffolk Superior Court jury today awarded $15 million to the family of a little boy who died after surgery at Children&#8217;s Hospital, saying doctors were negligent in their care of the three-year-old. </p>
<p>The verdict is the highest medical malpractice award in Massachusetts so far this year, according to Massachusetts Lawyers Weekly. </p>
<p>“I&#8217;m gratified. Very very gratified,” said Brian Fox, the father of little Jason Fox. “(The) jury had a tough job and they saw through what was true and what was lies. And it was a very appropriate verdict.” </p>
<p>Fox maintains that Children’s Hospital contributed to the death of their son and that doctors there engaged in a cover-up. One of those doctors is Harvard professor James Lock, the hospital’s cardiologist-in-chief. </p>
<p>As FOX Undercover reported last May, Jason was born in Pennsylvania with a heart defect and underwent many surgeries in his home state before doctors there referred him to Children’s Hospital in Boston. </p>
<p>Fox said his son was a playful little boy before the surgery but that things went very wrong at Children&#8217;s during the cardiac catheterization, and later in the intensive care unit. Jason was discharged three weeks after the surgery with what his father describes as massive, permanent brain injuries. He died soon in 2004. </p>
<p>Fox says he sued because the hospital and its doctors were not upfront about what happened. </p>
<p>“I can guarantee you that if we had been the recipients of candor instead misinformation, this would have never wound up in court,” he said. </p>
<p>The family’s attorney, James Fox said fighting the case was an “uphill battle.” </p>
<p>“We had tremendous difficulty finding expert witnesses with the courage to come forward and testify in this case,” he said. “It just shows you that the powerful are not immune to the conscience of the community and a jury.” </p>
<p>Children’s Hospital attorney William Dailey said he was “stunned” by the verdict. </p>
<p>“We represented five extraordinary doctors who took over the care of a child that had been found to be without recourse in Philadelphia. The doctors down there basically had indicated there was no further hope. They had indicated time was running out.” </p>
<p>“Jason came to Boston and the doctors here tried to provide the very best care they could,” he said. </p>
<p>Dailey said the hospital may appeal the verdict. It has 30 days to decide. </p>
<p>Children’s Hospital released a statement expressing disappointment with the verdict and insisting its doctors provided outstanding care to a very sick child. </p>
<p>The state Board of Registration in Medicine has already re-opened its investigation of the case. That investigation is ongoing.</p>

			<content:encoded><![CDATA[<p>FOX was hired by the mother of a Sacramento autistic teenager who was raped by a Cable TV installer outside her home. The company denied responsibility because the rapist had passed a background check.  Fox proved that the cableman had prior rape convictions from out-of-state and sued the company that performed the background check, along with the cable company. Even though the rapists had changed his social security number and birth date, Fox demonstrated there were enough red flags on the background report to have warranted further scrutiny.  During depositions, cable contractor employees took the 5th amendment when confronted with evidence that the rapist’s I-9 immigration form had been falsified Fox obtained a multi-million dollar annuity settlement for the teen, guaranteeing lifetime financial security.<br />
In other cases, Fox has successfully prosecuted cases on behalf of children sexually molested by their “special education” teachers; patients sexually assaulted by their doctors and psychologists.</p>
